Agreement to terms

These Terms of Use constitute a legally binding agreement between you, whether acting individually or on behalf of an entity (“you” or “user”), and The Pen is Mightier Content Creators LLC, doing business as Mightier Legal (“Mightier Legal,” the “Company,” “we,” “us,” or “our”). These Terms govern your access to and use of the AccidentBureau website at AccidentBureau.com, along with any associated mobile sites, applications, media, content, or services (collectively, the “Site”).

By accessing or using the Site, you confirm that you have read, understand, and agree to be bound by these Terms of Use.

If you do not agree to these Terms in their entirety, you are not authorized to use the Site and must discontinue use immediately.

We may supplement or update these Terms from time to time. Any additional terms or documents posted on the Site are incorporated into these Terms by reference. Continued use of the Site following any updates constitutes acceptance of the revised Terms.

Eligibility and jurisdiction

The Site is intended solely for individuals who are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Site.

The Site is operated from the United States and is not intended for use in jurisdictions where such use would violate applicable laws or regulations. Users who access the Site from outside the United States do so on their own initiative and are responsible for compliance with local laws.

No legal services

Mightier Legal is the company that operates AccidentBureau. It is not a law firm, does not employ or contract with attorneys to represent you, and does not provide legal advice or legal services.

Through the Site, we connect accident victims with a network of independent, vetted partner law firms. These firms are separate businesses, and partner law firms may compensate Mightier Legal in exchange for connections through the Site. Interacting with the Site — including submitting information or engaging through forms — does not establish an attorney-client relationship. Any attorney-client relationship is formed solely and directly between you and a law firm.

Legal services referenced on the Site may not be available in all states or for all types of legal matters.

Permission to share your information

The Site is provided to you at no cost. By using the Site and submitting your information, you consent to the collection of your contact details and accident-related information, and to our sharing that information with a partner law firm in our network for the purpose of responding to your inquiry.

You may be contacted by Mightier Legal and/or a partner law firm by telephone, email, or SMS regarding your submission. Use of the Site does not create any obligation on the part of a partner law firm to accept your matter.

Telephone Consumer Protection Act (TCPA) consent

By providing your contact information, you expressly consent to receive communications from Mightier Legal and the partner law firm matched to your inquiry, including calls, emails, and text messages, which may be delivered by automated systems or prerecorded messaging.

  • Message and data rates may apply.
  • Consent is not required as a condition of purchase or of receiving services.
  • You may opt out of SMS communications at any time by replying “STOP.”

Intellectual property rights

Unless otherwise stated, all content available on the Site — including text, graphics, logos, images, software, and other materials (collectively, the “Content”) — is owned by or licensed to Mightier Legal and is protected under applicable intellectual property laws.

The Content is provided for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, or exploit any portion of the Site or Content without prior written consent.

User representations

By accessing or using the Site, you represent and warrant that:

  • All information you provide is accurate, complete, and current.
  • You have the legal capacity to enter into these Terms.

Prohibited activities

Contribution license

Governing law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Charleston County, South Carolina.

Disclaimer

The Site is provided on an “as is” and “as available” basis. Your use of the Site is at your own risk. To the fullest extent permitted by law, Mightier Legal disclaims all warranties, whether express or implied.

We do not guarantee the accuracy, completeness, or reliability of any content or third-party services referenced on the Site.

Limitation of liability

To the maximum extent permitted by law, Mightier Legal and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site.

Our total liability, if any, shall not exceed the amount paid by you to us, if applicable, during the one (1) month preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Mightier Legal and its affiliates from and against any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

Electronic communications

By using the Site, you consent to receive communications electronically and agree that electronic records and signatures satisfy any legal requirement for written communication.

Waiver and severability

Miscellaneous disclosures

No consumer reporting agency: Mightier Legal is not a consumer reporting agency under the Fair Credit Reporting Act.

Public records: We are not the custodian of any public records.

Data accuracy: Accident-related data may be sourced from third parties and may contain errors or omissions.

Partner law firms: Communication from a partner law firm does not establish an attorney-client relationship; any such relationship is formed solely and directly between you and the law firm.
